Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Bina Cloud CMMS, our cloud-based maintenance management service for facilities (the “Service”), provided by Bina Cloud (“Bina Cloud”, “we”, “us”, or “our”). Please read them carefully.

1. Acceptance of these terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service. If you use the Service on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf.

2. About the Service

The Service helps facilities and organisations manage maintenance activities, including requests, work orders, assets, scheduling, and reporting. We may add, change, or remove features from time to time.

3. Your account

You may need an account to use the Service, which you can create with an email and password or by signing in with Google. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Please notify us promptly of any unauthorised use.

4. Acceptable use

You agree not to:

  • use the Service for any unlawful or unauthorised purpose;
  • interfere with or disrupt the integrity or performance of the Service;
  • attempt to gain unauthorised access to the Service or its related systems; or
  • upload content that is unlawful, harmful, or infringes the rights of others.

5. Your content and data

You retain ownership of the content and data you submit to the Service. You grant us the limited rights necessary to host, process, and display that content solely to provide the Service to you and your organisation.

6. Intellectual property

The Service, including its software, design, and content provided by us, is owned by Bina Cloud and is protected by applicable intellectual property laws. These Terms do not grant you any right to our trademarks or branding.

7. Service availability and changes

We aim to keep the Service available and reliable but do not guarantee uninterrupted access. We may suspend or modify the Service for maintenance, updates, or other operational reasons.

8. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties of any kind, whether express or implied, regarding the Service.

9. Limitation of liability

To the fullest extent permitted by law, Bina Cloud will not be liable for any indirect, incidental, or consequential damages, or for any loss of data, revenue, or profits, arising from your use of the Service.

10. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms or if we are required to do so by law. You may stop using the Service at any time.

11. Governing law

These Terms are governed by the laws of Malaysia, and any disputes arising from them are subject to the exclusive jurisdiction of the courts of Malaysia.

12. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Service after a change means you accept the updated Terms.
